What are the legal requirements when leasing a residential property?
In NSW, residential leases must comply with the Residential Tenancies Act 2010. A written tenancy agreement is legally required for fixed-term leases over three months and must include key terms such as rent amount, bond, duration, and responsibilities of each party. The landlord must provide a copy of the NSW Fair Trading information statement and lodge any bond with the Rental Bond Board. Smoke alarms must be installed and working, and the property must be reasonably clean, safe and fit for habitation at the start of the lease. If the property is managed by an agent, they must also be properly licensed.
What’s the difference between a residential and commercial lease?
Residential leases are governed by tenancy law and protect tenants’ rights in a private home, unit or apartment. They come with standard legal protections and are usually shorter-term. Commercial leases are private contracts between businesses and landlords and aren’t covered by residential tenancy legislation. They’re more complex, often longer in duration and usually negotiated based on the tenant’s business use. Commercial leases may include rent reviews, fit-out clauses, and conditions about signage or foot traffic. Legal advice is strongly recommended before signing a commercial lease, as there is far less regulation around tenant protections.
Can I break a residential lease early in NSW, and what are the consequences?
Yes, tenants in NSW can break a lease early, but there are legal and financial consequences unless specific grounds apply. If the lease is still within its fixed term, tenants must give written notice and are generally required to pay a break lease fee unless they qualify for an exemption, such as domestic violence, a social housing offer or entry into aged care.
The standard break fee for agreements signed after 23 March 2020 is calculated as a percentage of the remaining rent:
4 weeks’ rent if less than 25% of the term has passed
- 3 weeks if 25–50%
- 2 weeks if 50–75%
- 1 week if more than 75%
Tenants must also leave the property in good condition and may still be liable for rent until a new tenant is found. Landlords have a duty to mitigate loss, but tenants should expect to cover some costs related to advertising and reletting.
